LEGAL NOTICE

TAKE NOTICE THAT ELIZABETH TOWNSHIP WILL READ FOR ADOPTION THE FOLLOWING ORDINANCE AT THE PUBLIC MEETING OF THE BOARD OF COMMISSIONERS ON MARCH 4, 2019 AT 7:00M AT THE ELIZABETH TOWNSHIP MUNICIPAL BUILDING, 522 ROCK RUN RD., ELIZABETH, PA 15037:

 

AN ORDINANCE OF THE TOWNSHIP OF ELIZABETH, COUNTY OF ALLEGHENY, COMMONWEALTH OF PENNSYLVANIA, PROVIDING FOR THE ZONING OF OIL AND GAS DRILLING OPERATIONS.  THE PROPOSED ORDINANCE AMENDS AND RESTATES THE OIL AND GAS DRILLING OPERATIONS PROVISIONS OF THE TOWNSHIP ZONING ORDINANCE.  THE ORDINANCE AMENDS THE DEFINITION OF “OIL ABD GAS OPERATIONS”, AND ADDS DEFINITIONS FOR “FRESH WATER”, “FRESHWATER IMPOUNDMENT” AND “WASTEWATER IMPOUNDMENT OR CENTRALIZED IMPOUNDMENT.”  IT INCREASES THE SETBACK FOR OIL AND GAS WELLS OR GAS WELL SITES TO 750 FEET FROM EDGE OF PAD TO ANY EXISTING BUILDING AND 1500 FEET FROM EDGE OF PAD TO ANY SCHOOL PROPERTY LINE, INCREASES THE SETBACK FOR WASTEWATER OR CENTRALIZED IMPOUNDMENTS TO 500 FEET FROM AN EXISTING BUILDING, AND INCREASES THE SETBACK FOR OTHER OIL AND GAS OPERATIONS TO 500 FEET FROM AN EXISTING BUILDING.  THE ORDINANCE ADDS FRESHWATER IMPOUNDMENTS AS A CONDITIONAL USE IN ALL DISTRICTS, SUBJECT TO A SETBACK OF 300 FEET FROM AN EXISTING BUILDING, AND ADDS FRESHWATER INTAKE FACILITIES AS A CONDITIONAL USE IN ALL DISTRICTS, SUBJECT TO A SETBACK OF 200 FEET FROM AN EXISTING BUILDING.  SETBACKS MAY BE REDUCED IF THE AFFECTED PROPERTY OWNER SIGNS A WRITTEN WAIVER.  THE ORDINANCE INCREASES LIABILITY INSURANCE LIMITS AND REQUIRES INSTALLATION OF SOUND MITIGATION WALLS OR OTHER DEVICES ON THE  SIDES OF THE OUTER EDGE OF A WELL PAD WITHIN 750 FEET OF AN EXISTING BUILDING.

Public inspection may be made without charge, or a copy obtained for a charge not greater than the cost thereof.

A full copy of the Ordinance has been supplied to the newspaper of general circulation at the time this summary of the Ordinance is published.
