LEGAL NOTICE

NOTICE IS HEREBY GIVEN that the Board of Commissioners of Township of Elizabeth (the “Township”) will hold a special public meeting on Wednesday, April 3, 2019, at 6:00 P.M., prevailing local time, in the Commissioners’ Meeting Room at the Elizabeth Township Municipal Building, 522 Rock Run Road, Elizabeth, Pennsylvania 15037, for general purposes and for the purpose of considering, inter alia, the incurrence of non-electoral debt in the aggregate principal amount not to exceed $10,000,000, in connection with the a proposal from Boenning & Scattergood, Inc. (the “Underwriter”) for the purchase of the Township’s Guaranteed Sewer Revenue Bonds, Series A of 2019 (the “2019A Bonds”), and at such meeting, or in the alternative at a meeting of the Board of Commissioners of the Township held not less than three (3) nor more than thirty (30) days from the date of advertisement of this notice, the Township will consider the adoption of an ordinance (the “Ordinance”) summarized as follows:

The Ordinance authorizes the sale at private negotiated sale and the issuance of the 2019A Bonds, in an estimated aggregate principal amount not to exceed $10,000,000, awards the 2019A Bonds to the Underwriter; approves the form of the 2019A Bonds; fixes the maximum rates of interest to be paid; pledges the Pledged Revenues (as defined in the Indenture) for the payment thereof and as further security for the 2019 Bonds, authorizes the delivery of a guaranty pursuant to which the Township pledges its full faith, credit and taxing power for the payment of the 2019A Bonds; creates sinking funds; and authorizes the proper officers to take the necessary steps to issue the 2019A Bonds.  The funds to be obtained from the 2019A Bonds will be used to: (a) current refund all of the Township’s outstanding Sewer Revenue Bonds, Series of 2009, (b) fund various capital improvements to its sewer system, (c) fund a capitalized interest account, (d) fund a deposit to the debt service reserve fund, if required, and (e) pay the cost of issuing and insuring the 2019A Bonds.

Any amendments will be supplied at the time of the adoption of the Ordinance if the Township shall determine to proceed.

A copy of the full text of the proposed Ordinance may be examined by any citizen at the Administrative Office of the Township, at 522 Rock Run Road, Elizabeth, Pennsylvania 15037, on regular business days from 8:00 a.m. to 4:30 p.m., prevailing time.

Notice of Public Hearing

 

The Elizabeth Township Board of Commissioners will hold public hearings on April 15, 2019 at 6:00 pm at the Elizabeth Township Municipal building located at 522 Rock Run Road. Hearings will be held on the following conditional use applications and all interested persons may appear at the hearing.

A conditional use application submitted by Huntley & Huntley Energy Exploration, LLC for the Ceto aboveground fresh water storage tank to be located at 1665 Fallen Timber Rd. on a parcel owned by Scott & Cynthia McCall with Parcel ID 1414-H-136 and a parcel address of 1663 Fallen Timber Rd.

A conditional use application submitted by Huntley & Huntley Energy Exploration, LLC for the Galene freshwater intake facility located at 0 P&LE RR Parcel ID 1413-J-255 owned by Elizabeth Township and the Galene waterline to be located on parcels 1413-J-25 & 1413-E-299 owned by Elizabeth Township, parcel 653-K-398 owned by the Regional Trail Corporation and parcel 1414-H-136 1663 Fallen Timber Rd. owners Scott & Cynthia McCall.
